Medicaid Transport Recovery Amount

DUI Negligence Amount
My client was rear ended by a DUI (drunk) driver as she waited for a traffic light. The intoxicated driver fled the scene on a flat tire.
Wrongful Death / Inadequate Medical Care
A local jail failed to provide medical treatment for our client’s diabetes while he had been jailed on a probation revocation. As a result, our client lapsed into a coma and later died from untreated diabetes. We litigated this case for 9 years. In that time, the trial court dismissed the action twice requiring use to appeal to the Georgia Court of Appeals. On both appeals, the appellate court agreed with our reasoning and reversed the trial court- a very rare event. Evidence demonstrated that the Jail provided substandard medical care to inmates, including our client. The case settled in mediation shortly before trial.
Hit and Run Driver
A hit & run driver struck our client at the intersection of Buford Highway and North Druid Hills Road in Dekalb County (Atlanta) as she was a passenger in a taxi. She was severely injured and suffered fractures to both her hips, pelvis as well as internal injuries. After the collision, the at fault driver locked the doors to his car and ran from the scene. There were no witnesses who could identify him. Approximately ten minutes later he reported the car stolen. The insurance company refused to cover the loss. After two years of litigation, the hit and run driver continued to insist the car was stolen and his insurance company continued its refusal to pay. One week before trial, our investigation uncovered evidence that forced the insurance company to accept responsibility.
A drunk driver (intoxicated) struck and severely injured our client in the Roswell Alpharetta area. Our client suffered leg (“femur fractures”) to both legs. The DUI driver was a North Fulton County school teacher. The investigating officer did not suspect the drunk driver was DUI and did not charge her at the scene. When we entered the case, we immediately requested a report of the driver’s blood alcohol level. We learned that she had been highly intoxicated at the time of the accident. This information, combined with compelling witness statements, helped produce a superior settlement.
Medical Transport (Non-Emergency)
A driver operating a senior shuttle van bus was following another vehicle too closely near Piedmont Hospital in Atlanta requiring a sudden stop. The shuttle bus driver failed to secure our client inside the van. She was elderly and wheelchair bound. As a direct result of the shuttle van driver’s actions in failing to secure the wheelchair and in stopping suddenly, our client was thrown to the floor of the van causing fatal injuries. The case settled for the insurance policy limits.
Driver was speeding / Reckless driver
A speeding driver who was weaving in and out of rush hour traffic, lost control and injured our client as he walked down a sidewalk in Roswell, Georgia. The at-fault driver had been “test driving” a Dodge Viper for a local Alpharetta dealership.
Fatality / Settlement is confidential
$1,714,608 – Demand
A municipal bus pulled in front of the car driven by our client’s husband. As a result of the collision, our client was killed. The case settled after we provided evidence demonstrating that our client’s life was filled with family, friends, and church involvement.
Tractor Trailer Accident
My client was driving alongside a tractor trailer on I-285 in Dekalb County, Georgia. The truck driver made a lane change and side-swiped my client. The impact caused her to lose control and strike the median wall. The insurance defense attorneys aggressively defended the case. They argued that the accident was minor. They claimed there was little damage to my client’s car. A personal injury lawyer with no experience in truck accidents may have settled the case for $50,000.00. In fact, this was the insurance company’s offer- and they adamantly refused to offer more. I looked deeper into the case. I sought to uncover the reason for the accident. I applied my knowledge of the Federal Motor Carrier Safety Regulations. The regulations require trucking companies to train their drivers. The FMCSR’s also require trucking companies to make sure their truck drivers do not exceed their hours of service. The truck driver had exceeded his hours of service and had not been trained. During my investigation, I learned that the trucking company knew the regulations but chose to ignore them. The case settled in mediation for $700,000.00.
Tractor Trailer Accident
My client was a former body builder driving one early morning to LA Fitness in College Park, Georgia. While driving in the right lane, she was sideswiped by a UPS tractor trailer. The impact caused her to spin out of control. She injured her shoulder and ultimately required arthroscopic surgery. She incurred approximately $23,000.00 in medical bills. She had three prior auto accidents with injuries and one subsequent bus accident resulting in severe back injuries. Her history of other accidents before and after her tractor trailer collision were considered “bad facts” detrimental to her case. Defendant’s offer of settlement was $75,000.00. Based on jury verdict research, comparable settlements for this case were $75,000.00. With the client’s approval, I settled the case in mediation for $175,000.00. The settlement added $100,000.00 over the last offer from the insurance company. The mediator noted that it was the largest settlement he had seen for a case of this type. This was a “win” for my client. More importantly, she was given the right to choose and was not forced to accept whatever figure the insurance company determined they would pay.
Distracted driver / Driver who was Texting Caused an Accident
A distracted driver lost control of his car, left the roadway and struck our client in Duluth, Gwinnett County. Our client had been mowing a commercial property while working for a lawn maintenance company. He was severely injured. After conducting an investigation, we settled the case for the insurance policy limits after submitting a policy limits demand to both the at fault driver and our client’s uninsured motorist (“UM”) coverage.

As a result of the collision, our client was hospitalized. He suffered fractured ribs, chest contusions, a collapsed lung and a fractured pelvis. We submitted a policy limits demand to the insurance company for both the at fault truck driver and our client’s uninsured motorist (“UM”) coverage. The case settled for the insurance policy limits.

A truck driver rear ended my client as he was driving on I20. The tractor trailer was operated by an intermodal motor carrier which had a record of unsafe operation including falsified driver logs and accidents caused by fatigue. My client suffered a cervical herniation.
Driver who was driving in the wrong lane
The at fault driver left his lane and struck our client head-on. Our client suffered a fractured knee (patella) and required surgery. After investigating the case, we submitted a policy limits demand to the insurance company. The case later settled for the insurance policy limits.
Rear end collision
Our client was rear ended and suffered suffered cervical injuries including whiplash, disk herniations, and chronic pain syndrome.
After obtaining a policy limits settlement from the at fault driver, we filed suit against the insurance company for their uninsured motorist coverage. After taking the deposition of the at fault driver, the insurance company realized they did not have a viable defense to the case and tendered their policy limits. The case settled.
My client was rear ended by a drunk driver as she waited for a traffic light. The intoxicated driver fled the scene on a flat tire. The DUI driver was then arrested at a nearby Marta Station attempting to hide from the accident he caused. The case settled after I obtained police records and the Marta video which captured the drunk driver’s actions.

The investigating officer testified that the intoxicated driver admitted at the scene that he had been drinking yager shots shortly before driving. When asked by the officer how drunk he was on a scale of 1 to 10, the driver conceded he was an “8.” We settled the case for the insurance policy limits.
Distracted Driver / Driver who was talking on a cell phone
A driver who was distracted struck our client as he and his wife attempted to walk across Monroe Avenue to Piedmont Park in the Atlanta Dekalb County area. Eyewitnesses at the scene testified that the at fault driver must have been distracted or talking on her mobile phone at the time of the accident. According to witnesses, there was no reason why the driver should not have seen our client walking across the street since he was in the cross walk and was walking with the light. We settled the case after submitting a demand to the insurance company.
Tractor Trailer Accident
A truck driver hauling cargo near Spaghetti Junction in Atlanta lost a piece of equipment from his truck which fell on the roadway. Our client was traveling behind the eighteen wheeler at the time and was unable to avoid the debris. As a result, he lost control of his motorcycle and was injured. We settled the case after submitting a demand to the insurance company.
A drunk driver leaving a club in Midtown Atlanta rear ended our client. After the accident, the driver fled the scene by attempting to hail a taxi cab. We obtained a statement from the investigating officer that the driver was so drunk that he had to lift her out of the taxi cab in order to arrest her. The case settled for the insurance policy limits.
